Article 1 – Accessibility
The Site is generally accessible to users 24/7, except for scheduled or unscheduled interruptions for maintenance or in cases of force majeure.
In the event that access to the Site is unavailable, the Site undertakes to do its utmost to restore access. The Site shall not be liable for any damages, regardless of their nature, resulting from its unavailability.

These general terms and conditions of sale apply to all orders sent to us by mail, fax, email, or placed on our website www.begenat.com.
Any order automatically implies the customer’s unconditional acceptance of these terms and conditions of sale.
Article 3 – Product Photographs and Technical Specifications
The photographs contained in this catalog are not contractually binding.
The technical specifications of the products are for informational purposes only. BéGéNat reserves the right to modify these specifications to improve the product or to compensate for a manufacturing interruption.
Article 4 – Ordering Procedures
Orders must be placed by mail, fax, or email (details below) and must include the delivery and billing addresses (separate if different) and a telephone number.
We do not accept orders by telephone.
Article 5 – Payment Terms
Schools located in mainland France, the French Overseas Territories, and Corsica:
Payment is due upon receipt of the invoice by check payable to BéGéNat, or by bank transfer (bank details appear on the invoice) or money order.
BéGéNat reserves the right to request prepayment under special conditions (unpaid invoices, customer financial difficulties, etc.).
In the event of partial shipment of an order, an invoice corresponding to the shipped goods will be sent to the customer. The customer may not, under any circumstances, withhold payment on the grounds that the order has not been delivered in full.
Individuals, businesses, and establishments established abroad:
Unless otherwise agreed with BéGéNat, a full prepayment may be required.
Article 6 – Prices
BéGéNat has strived to maintain the best possible value for money. Its prices, including VAT, take into account the complexity of the process and the types of coloring.
Article 7 – Delivery Times
BéGéNat has most of its preparations in stock, allowing for very rapid delivery. For urgent orders, please contact us. Prices are inclusive of VAT and valid until August 31, 2018.
For export orders, there is no VAT. No packaging fees will be charged: preparations and thin sections are delivered in free storage boxes. You are only responsible for shipping (see table below). If your order reaches or exceeds €300 including VAT, shipping is free (except for special freezer shipping) for mainland France only.

“Special freezing” shipping costs (only for mainland France):

Article 8 – Liability
BéGéNat shall not be held liable for non-performance of the contract in the event of product out-of-stock or unavailability due to force majeure, disruption, or total or partial strike, in particular of postal services, means of transport and/or communications.
BéGéNat cannot be held responsible for any indirect damages that may arise from the purchase of the products.
In the event of non-receipt of an invoiced order or part of an invoiced order, the customer has a maximum of five months (from the invoice date) to respond. After this period, no claims will be accepted.
BéGéNat cannot be held responsible for the use of the products sold.
Products must be used in compliance with legal requirements for personal hygiene and safety.
Article 9 – Treatment of Waste Electrical and Electronic Equipment
Regarding products marketed by BéGéNat and covered by Article 18 of Decree No. 2005/829 relating to the disposal of waste from electrical and electronic equipment, the end user is responsible for organizing and financing the removal and treatment of the resulting waste.
Article 10 – Delivery
All goods are delivered at the recipient’s risk.
The buyer is required to check, in the presence of the carrier, the condition of the packaging and its contents upon delivery. In the event that the buyer has any doubts whatsoever about the condition or contents of the package, the buyer must indicate this in the form of handwritten reservations accompanied by their signature on the transport slip presented by the carrier. This verification is considered complete once the buyer, or a person authorized by the buyer, has signed the transport slip.
The buyer must also confirm their reservations no later than 7 business days following receipt of the item(s) to BéGéNat – 8, impasse de la Mesnillière – 14790 VERSON or by fax to 02 31 26 22 39.
Any claims made after this deadline will not be accepted. Reshipping costs related to NPAI, unclaimed or refused packages or incomplete addresses are the responsibility of the customer.
Article 11 – Right of Return
In accordance with Article L.121-16 et seq. of the French Consumer Code, the buyer has 14 working days from receipt of their package to notify BéGéNat of their wish to return the product. From the date of the return request, the buyer has 15 working days to return the product to us at their own expense. No returns will be accepted beyond this period unless written consent has been obtained.
Returned items must be shipped in their original packaging, complete, and in good condition. The sender must ensure that they use appropriate packaging and protection. Returned items are the sender’s responsibility during transport; any item damaged during return transport will not be exchanged or refunded. Returns must be made to the following address:

Uncataloged products will not be returned or exchanged. Products on sale or cleared out of stock on the website will not be returned or exchanged except for private individuals and in the case of hidden defects. Animals for dissection, frozen organs, and chemical products will not be returned or exchanged.
Article 12 – Warranty
Unless otherwise stated in the catalog, items (mechanical, electrical, or electronic) delivered by BéGéNat are guaranteed for 1 year for parts and labor. The warranty period begins on the invoice date (corresponding to the product’s shipment date). The invoice serves as a warranty certificate, and a copy must be submitted with any request for equipment service.
Improper use of the equipment noted by our technical services will void the warranty. In this case, a quote for repairs will be provided to the customer for acceptance.

Article 13 – Intellectual Property
BéGéNat retains intellectual property rights to all marketed products and their accompanying technical instructions.
Any copying, in whole or in part, or any use of these products or their contents would constitute an infringement of intellectual property rights and could be subject to legal sanctions.
Article 14 – Applicable Law and Jurisdiction
Sales of BéGéNat products are subject to French law. Any dispute relating to the interpretation, execution, or termination of the contract concluded between BéGéNat and the customer, even in the event of multiple defendants, will, in the absence of an amicable agreement, be subject to the exclusive jurisdiction of the courts of… (for professional buyers).
